ALERT: WA STATE EMPLOYERS

WA state employers (employers whose business operates by way of a partnership, sole trader arrangement or a trust with a personal /partnership as trustee) should be aware that significant changes to employment laws are coming into force on 31 January 2025.
In summary the changes are as follows:

- Confirmation that casual employment is employment that is characterised by irregular hours with no guarantee of ongoing employment. When determining if an employee is a casual employee the true nature of the employment relationship must be considered.
- An increase to the casual loading from 20% to 25%.
- Provision for employees with 12 months’ continuous service to seek flexible working arrangements in certain circumstances.
- An entitlement for all employees to be absent from work on a public holiday with employers able to request employees to work on a public holiday if the request is ‘reasonable’.
